SAMARCU undertakes to protect and safeguard the privacy of users of its website. This privacy policy explains how our company, in synergy with its partners, intends to protect information gathered for the use of our products and services: this information formalises SAMARCU’s commitment to transparency regarding users’ data it collects, the way they are used and how they are shared.

The purpose of this document is to provide all the necessary information data subjects require to express informed, explicit consent, if applicable, to the processing of their data. Right of Access, Rectification and Erasure

Data subjects using this website may exercise their rights under the terms of art. 7 Legislative Decree 196/2003, and arts. 15, 16 and 17 of Regulation 2016/679, including the right to consult, update, correct or erase data, withdraw consent and object to processing on legitimate grounds, by contacting the data controller by certified email (PEC) to privacy@otlav.it .

The data subject also has the right to lodge a complaint with a supervisory authority (for Italy, Garante della Privacy, http://www.garanteprivacy.it ), if he or she deems that the processing of his or her data is unlawful.

Data Provided by Data Subjects

Personal data in our possession will not be transferred to third parties and every effort will be made to ensure the security and confidentiality of such data, pursuant to current law. Provision of data is optional and necessary to perform the services offered on the website, allow Otlav to respond to requests for information, documentation and updates on its products and/or collect feedback on their use.

In any case, the data processing will be restricted to Europe. The data subject consents to communication of data to:

  • Our subsidiaries or associated companies;

  • Providers of professional services, outsourced consultants and other subjects who have commercial or contractual relationships with our company within the scope of our relationship with the data subject.

Scope and Legal Basis, Obligatory or Optional Nature of Processing

Otlav will process personal data provided by users only in the way established in this privacy policy and in observance of current law. Personal data collected through our website will be used for the following purposes:

  1. marketing, notifications and promotions of our company and our products (marketing activities); in these cases the legal basis is the consent of the data subject.

Consent can be withdrawn at any time; the data subject may interrupt receipt of these communications at any time and without cost, by writing to privacy@otlav.it. Such withdrawal shall not affect the lawfulness of processing based on consent before its withdrawal.

Contact data will be held until consent is withdrawn. With specific reference to registration for our newsletter, this will continue to be sent until consent is withdrawn. In any case, the data subject may freely unregister at any time by activating the procedure at the bottom of one of the newsletters received.

Furthermore, information will be collected through suitable tracking systems relating to opening and reading messages for the purpose of measuring the perceived quality of our service and optimising use.

In such case, the data collected shall be processed in fulfilment of legal requirements connected to civil, fiscal and accounting regulations and to administration of the relationship. These data will be held for the period required by specific legal obligations and current applicable regulations.

Recipients of Personal Data and Transfers

Data subjects’ personal data may be forwarded to the subjects listed below (Recipients):

  • Subjects who act as Otlav’s partners and work with us to promote products and services in common.

  • Subjects who typically act as processing officers, e.g. natural or legal persons who provide assistance and consultancy in accounting, administration, law, taxes, finance and credit collection linked to the provision of services, mailing of advertising material or contractual communications, event planners, and subjects who provide services for web meetings and web seminars;

  • Subjects who provide email services (email platforms), delegated to run deletion messages sent by users for marketing purposes;

  • Subjects delegated to perform technical maintenance (including maintenance of the network and electronic communications network apparatus);

  • Persons authorised to process the personal data needed to carry out activities strictly linked to the provision of products/services; such persons have a legal obligation to confidentiality;

  • Competent subjects, entities or authorities for which it is mandatory to communicate personal data in order to fulfil legal obligations and prevent infringement and fraud.

The names of such subjects and their contact info are available in response to a specific request by email to privacy@otlav.it .

In any case, such transmission of data will take place within the EU or USA, under the EU-USA Privacy Shield agreement, and exclusively for the purposes described above.

Navigation Data

During normal operation, the software procedures for the functioning of these websites acquire, for example, pages read and IP addresses.
